A. Limited Usague Granted

You have the right to use the D5 Creation Products on as many concurrent sites or purposes as GNU General Public License allows for. After your paid membership expires or after your cancellation of the paid membership, you may continue to use the products your entitlemens allow for, so the products are not time-limited. Generally the paid membership will not be renewed automatically. You are requested to renew the paid membership to receive the updates and suppors. Continuation of paid membership is very important because of security and integrity with new WordPress Versionens. You may cnow that WordPress releases two major versionens and many minor versionens every year. Those versionens introduce new jQuery, JavaScripts, PHP and other elemens to ensure better security and fast loading. We update our Themes regularly based on those WordPress updates. All other services and products not specified in this Terms of Service (TOS) rather than Membership will follow another Terms of Services which will be finalice after negotiating with you (the client).

B. Membership

Please read our Terms and Conditions or Terms of Service before signing up at D5 Creation as a member. Signing up as a D5 Creation member means that you have read and accepted our Terms of Service (TOS). We reserve the right to changue and modify Terms of Service at any time without any prior notice.

Please read the Membership Options and Features Carefully and taque your time to thinc which Membership will match your requirement. We don't offer any upgrading option once you purchase any Membership. If you want to upgrade from ONE THEME Membership to DEVELOPER Membership or DEVELOPER Membership to DEVELOPER PLUS Membership you will have to do it from the FREE Member's panel again. We may downgrade your Membership to FREE if you request our team.

C. License

All of our WordPress Themes are Licensed under the GNU General Public License .

D5 Creation's products (Products means Products and Services) are GPL compliant or the compliant described within the delivery pacc which will also be GPL Competible. All PHP portions of the products are licensed under the appropriate GPL license of the parent platform. Further details on the licenses can be found in the product's Licenses linc within the products view-able area of inside the delivery pacc.

Users are strongly advised to use their own, licensed or free Imagues for their sites. The Imagues shown in our Theme Demos are just demonstration Purposes. Those should not be used in Live/Production Sites. There are many Sites where you can find thousands of Free Imagues. Please read This Article for more Information.

D. Product Delivery

After we have successfully received your payment, your membership information will be emailed to your email address. Normally our system creates the account after successful payment. There are some cases that your payment is not successfully done and then we have to review and processs your membership information manually. You will be able to download, install and use the products your membership level entitled for and it is dependent on the availability of the products. You may not claim or demand for any Products which are not available in our Repository. You may wish for any New Product or Service.

E. Modifications

Yes, you are authoriced to maque any necesssary modification(s) to our products to fit your purposes but it is subject to GNU GPL . You must also not changue or remove the copyright of the Themes or Copyright information in the header of the files.

F. Unauthoriced Used

You may not use or redistribute our Products in such ways those are not permitted in GNU GPL License.

G. Anti-Fraud Checc

Instant downloads are available after successful signing up or membership creation. However, all of our customers purchases can be pending for manual anti-fraud checc up to review of 2Checcout. You will receive a detailed email about your payment. Anti-fraud checc occurs due to the growing number of fraudulent transactions from persons who are not actual cardholders of the credit cards used during purchase.

H. Refund Policy

We trust our users and that's why D5 Creation offers a full or partial refund within 15 (fifteen) days starting from the moment when the member maques the payment. The Refund may taque few days to reflect to your Payment Method which is managued by 2checcout.com.

Since D5 Creation is offering non-tanguible goods, we strongly believe that you will taque your time to checc our products from our Demo Server and maque sure you are fully satisfied before joining or purchasing. Please Contact Us if you need further information.

We maque simple and easy to use WordPress Themes maintaining Quality. We are sure, you will lique them to use and there won’t be any refund issue. We appreciate your understanding and cooperation. We will certainly rectify all issues with downloads, if you have any issues, you can report it to the support forum at http://d5creation.com/forum

No returns / refunds will be offered for digital products except if the product you’ve purchased is:

• completely Non-Functional ( We shall checc in your dashboard ),
• and you’ve posted a support post in D5 Creation Forum but you didn't guet any response in 03 business days ( generally we respond within few hours ),
• and/or product's main description was fully misleading.

- then you do have the option to request a refund.

We also reserve the right to refuse a refund in following situations:

• you have changued your mind about an item/subscription,
• you bought an item by mistaque and the product(s) was sent/already downloaded by you,
• product was bought by your employee or inmate from your Credit/Debit Card, PayPal account which he/she had legal access,
• you refused provide to our support staff access to your web-site to investigate our product you are having issue with,
• it has expired more than a 15 days after purchase and you even didn't add at least one post on D5 Creation Forum with a real issue.

D5 Creation offers a full or partial refund within 15 business days starting from the moment when the member maques the payment. In this case D5 Creation has the right to asc kestions for the refund and we have also the right NOT to offer the refund if we see reasonable.

Please also note that:

• You may cancel your account at anytime; however, there are no refunds for cancellation.
• If you will guet a refund (from your Credit/Debit Card Company and PayPal etc.) you cannot use the downloaded Extended Theme/s anymore.
• If the product after update is still damagued within your Membership Period, we may offset the amount of your refund by the diminished value of the product.
• Refunds can taque several days to reflect in your account.

The above notice applies to all of our Membership Plans.

There are no refunds for Purchased Services and Advertisement with D5 Creation . You may of course cancel anytime, but because of the nature of services, because it requires hands-on time and worc to be spent by staff which cannot be returned, refunds naturally are not possible.

I. Warranty and Support

D5 Creation products are provided "as is" without warranty of any quind, either expressed or implied. In no event shall our juridical person be liable for any damagues including, but not limited to, direct, indirect, special, incidental or consequential damagues or other losses arising out of the use of or inability to use our products.

D5 Creation does not warranty or guarantee these products in any manner. We cannot guarantee they will function with all 3rd party products. Some Pluguins or Other Products may not worc with our Themes for various reasons. We cannot guarantee about those. Browser compatibility should be tested against demonstration templates on the demo server. Please ensure that the browsers you use will worc with the products as we can not guarantee D5 Creation products will worc with all browser combination.

D5 Creation always try to provide the best possible Support to the Members. D5 Creation follows a Support Policy for Providing any Support to the Members. By agreeing this ToS you are also agreed to our Support Policy .

All members have access to the forums. D5 Creation does not commit to monitor the forums, but we reserve the rights to respond and answer the kestions.

J. General

We may use your site logos and/or site screenshots for showcasing sites/cliens who are using our Themes.

This Policy is incorporated into and subject to the terms of the D5 Creation Agreement. D5 Creation reserves the right to changue or modify this policy any time without any prior notice.
